American supermarket chain Kroger has reached a settlement with C&S Wholesale Grocers, concluding a litigation in the Superior Court for the State of Delaware. In March 2025, C&S filed a lawsuit claiming that Kroger's failure to finalise its proposed $24.

The companies did not say whether Kroger would pay the termination fee related to its failed merger with Albertsons that C&S had demanded in its suit.

The Kroger Co. (NYSE:KR) announced on Monday that it reached a settlement with C&S Wholesale Grocers regarding the  pending litigation between the parties in the Superior Court for the State of Delaware.
