The brother of the late San Jose-raised NFL player and Army hero Pat Tillman faces a fire destruction count that parallels his prosecution in Santa Clara County.

The DOJ said 44-year-old Richard Tillman faces a federal arson charge for the fire in the early morning of July 20.

The brother of former NFL star Pat Tillman told police that he was trying to make a statement to the U.S. government at the scene of a San Jose post office crash and fire, according to newly filed court documents.
