The company behind an $8.9 billion carbon-capture pipeline proposed for five Midwestern states said Wednesday it wants to indefinitely delay its plans after South Dakota passed a law limiting its ability to acquire land for the project.

Pipeline company Summit Carbon filed a motion with state regulators to suspend its permit application and extend a permit decision "indefinitely."

South Dakota Gov. Larry Rhoden signed a bill into law today that prohibits eminent domain for pipelines carrying carbon dioxide – including the 2,500-mile project proposed by Summit Carbon Solutions.

PIERRE, S.D. ( South Dakota Searchlight) – Summit Carbon Solutions wants the schedule of proceedings for its South Dakota permit application “paused for review and adjustment” after the state’s Legislature and governor approved a ban on the use of eminent domain for carbon dioxide pipelines.

The legislation would prohibit carbon pipeline companies from acquiring land by eminent domain. That’s the right to access private property for projects that benefit the public, with just compensation determined by a court. Eminent domain is commonly used for projects such as electrical power lines, water pipelines, oil pipelines and highways.
